Abstract

This work seeks to demonstrate criminal investigation as an essential public instrument in criminal prosecution, highlighting the leading role os the Judicial Police as a State institution in the defense os justice, as well as the express absense of constitucional authorizations for another institution to exercise this role. The police investigation, its mais product, stands out as a fundamental piece, structured by constitucional guidelines that guarantee its legitimacy. The Judicial Police Plays a central role in protecting society and citizen's rights, and its autonomy is essential and effective investigations. Issues relating to investigation and police inquirity will be adressed, in addition to the constitucional guidelines that govern the preliminary investigation, deconstructing the view of its non-essentiality and reaffirming its role in defending the public interest and guaranteeing fundamental rights.

Master in Public Law from Estácio de Sá University (UNESA, RJ). Specialist in State Law from the Federal University of the State of Bahia (UGBA, BA). Graduated in law from IESUS (BA). Professor of Criminal Procedural Law. Professor at ACADEPOL (PCMG). Professor of several postgraduate courses. Author of legal works. 

  • SANTOS, C. M. F. , Civil Police of Minas Gerais

    Specialized in Administrative Law (2017) and Criminal Law and Criminal Procedure (2016) from the Faculty of Administrative Studies os Minas Gerais (FEAD). He is also a specialist in Constitucional Law from University Gama Filho (2013). Graduated in Law from the Promove Law School (2012). He worked as tutor professor at SENASP focusing on Conflict Mediation (MCVA) and Comunity Mediation (MCOM) courses. He served for more than ten years with the Riot Policia Battalion of the Military Policia of Minas Gerais (BpChq) and currently holds the position of investigator at the Civil Police of Minas Gerais.
